These Terms of Service ("Terms") govern your access to and use of the website, online store, and services operated by hsonlinegroup ("hsonlinegroup," "we," "us," or "our"), and your purchase of any products from us. By accessing our website, placing an order, or otherwise using our services, you ("you," "your," the "customer," or "user") agree to be bound by these Terms. If you do not agree to these Terms, do not use our website or place an order.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, and able to form a legally binding contract, to use our website or place an order. By using our services, you represent and warrant that you meet these requirements and that all information you provide is accurate and complete.

2. Products Are Made to Order by a Third-Party Manufacturer

Our products are produced on a print-on-demand basis by an independent third-party manufacturing and fulfillment provider. hsonlinegroup operates as a storefront and reseller. We do not manufacture, warehouse, print, pack, or ship the products ourselves.

You acknowledge and agree that:

  • Product colors, sizing, placement, and finish may vary slightly from images shown on screen due to monitor settings, manufacturing tolerances, and the made-to-order process;
  • Such variations are normal and do not constitute a defect;
  • Manufacturing, fulfillment, and shipping timelines are controlled by our third-party partner and are estimates only, not guarantees.

3. Orders, Pricing & Acceptance

All orders are offers to purchase and are subject to our acceptance. We reserve the right, at our sole discretion, to refuse, cancel, or limit any order for any reason, including suspected fraud, pricing or product description errors, or unavailability.

Prices, product descriptions, and availability are subject to change without notice. In the event of a pricing or typographical error, we reserve the right to cancel any orders placed at the incorrect price, even after an order has been confirmed.

4. Shipping, Delivery & Risk

Shipping times are estimates only and are not guaranteed. Once an order is handed to the carrier, delivery is outside our control. We are not liable for delays, damage in transit, misdelivery, customs holds, or loss caused by carriers or events beyond our reasonable control. You are responsible for providing accurate shipping information; we are not responsible for orders that fail to arrive due to errors in the address you provide. Risk of loss and title for products pass to you upon our delivery to the carrier.

5. Returns & Refunds

Returns and refunds are governed exclusively by our Refund & Return Policy, which is incorporated into these Terms by reference. Except as expressly stated in that policy, all sales are final. Because items are custom-made to order, we do not accept returns or issue refunds for change of mind, wrong size, or wrong product selection.

6. Custom, Personalized & User-Submitted Content

If you submit any text, images, artwork, designs, or other content for a custom or personalized product ("User Content"), you represent and warrant that:

  • You own or have all necessary rights, licenses, and permissions to use and reproduce the User Content; and
  • The User Content does not infringe any copyright, trademark, publicity, privacy, or other right of any third party, and is not unlawful, defamatory, or obscene.

You grant us and our fulfillment partner a non-exclusive license to use and reproduce the User Content solely to fulfill your order. You are solely responsible for your User Content, and you agree to indemnify and hold us harmless (see Section 9) from any claim arising out of it. We may refuse to produce any order that we believe, in our sole discretion, may be infringing, unlawful, or objectionable.

7. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, OUR WEBSITE, SERVICES, AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the website will be uninterrupted, secure, or error-free, that defects will be corrected, or that any product will meet your expectations. No advice or information, whether oral or written, obtained from us shall create any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • In no event shall hsonlinegroup, its owners, officers, employees, agents, suppliers, or fulfillment partners be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) our website, services, or products, whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.
  • Our total aggregate liability to you for any and all claims arising out of or relating to these Terms, the website, the services, or any product, shall not exceed the total amount you actually paid to us for the specific product giving rise to the claim.

Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so some of the above limitations may not apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for fraud, death, or personal injury caused by our negligence).

9. Indemnification

You agree to defend, indemnify, and hold harmless hsonlinegroup and its owners, officers, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the website or services; (b) your violation of these Terms; (c) your violation of any law or the rights of any third party; or (d) any User Content you submit, including any claim that it infringes intellectual property or other rights.

10. Third-Party Manufacturer & Links

Our products are fulfilled by an independent third party, and our website may contain links to or integrations with third-party services. We are not responsible or liable for the acts, omissions, products, content, policies, or practices of any third party, including our manufacturing and fulfillment partner or any carrier. Your sole remedy with respect to product quality is as set out in our Refund & Return Policy.

11. Intellectual Property

All content on our website — including logos, text, graphics, store designs, and product images (excluding your User Content) — is the property of hsonlinegroup or its licensors and is protected by intellectual-property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission.

12. Force Majeure

We shall not be liable or responsible for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, pandemics, war, terrorism, labor disputes, supplier or manufacturer failures, carrier delays, governmental actions, power or internet outages, or other force-majeure events.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or your purchase shall be resolved exclusively in the state or federal courts located in the Commonwealth of Virginia, and you consent to the personal jurisdiction of such courts.

Optional — binding arbitration & class-action waiver (remove if not desired): At our election, any dispute shall be resolved by final and binding arbitration on an individual basis. You and we waive any right to a jury trial and to participate in a class action.

14. Changes to These Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. Changes are effective when posted on this page with an updated "Last updated" date. Your continued use of the website or placement of an order after changes are posted constitutes acceptance of the revised Terms.

15. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining Terms remain in full force and effect. These Terms, together with our Refund & Return Policy and Privacy Policy, constitute the entire agreement between you and us and supersede all prior agreements.
